Allen Smith- An amendment has been slipped into the House Transportation bill, called the Denham Amendment. It must be stopped.

The amendment, introduced by Representative Jeff Denham from Turlock, California, has introduced this legislation which could substantially reduce the amount truckers are compensated.

The amendment will  essentially override state’s laws, which protect drivers from wage theft. The amendment will allow trucking companies to pay drivers only for the time they spend driving, despite the fact that drivers are required to spend a great deal of time performing non-driving duties in fulfillment of their employment, many times in excess of 20% of their work day.

The Denham amendment was sneakily slipped in at the 11th hour with the hopes that no one would notice. If this amendment is passed and remains in the transportation bill, it will mean the following for professional drivers.

Motor Carriers will only have to pay employees on a piece rate basis,, many know this as cents per mile. It means that legally, by law, any work performed, other than when your wheels are rolling, employers are not obligated to pay you. That includes: detention time, safety inspections, pre and post trips, paper work, ANYTHING other than when those wheels are not rolling.

The Denham Amendment states that as long as the total number of hours you worked for your legal work week or pay period, equals at least MINIMUM WAGE, then your employers are not obligated to pay you anything more.

This Amendment is nothing more than a way to create laws that would prevent Drivers from EVER enacting any type of supplementary pay for all their work.

Currently, both the House of Representatives and the Senate have passed their versions of a long-term highway bill. The House version includes the Denham Amendment, however, the Senate version does not.

In order to get to a final version of a highway bill a conference committee made up of the representatives (conferees) – from both the House and Senate will meet to negotiate differences in the bill. The decision as to whether or not to include the provision eliminating your rights will be made by November 20, 2015.
